Property firm fined for lack of site fencing
A property firm has been prosecuted by the Health and Safety Executive (HSE) for putting its workers at risk after allowing them to work in an excavation without safety measures.
HSE inspectors made an unannounced visit to the site on Trafford Road, Alderley Edge in August 2010 where Huntmere were developing a luxury five bedroom mansion.
The HSE inspectors issued an immediate Prohibition Notice, ordering two workers to leave the excavation until the site had been made safe.
Macclesfield Magistrates’ Court heard no barriers or site fencing had been erected to keep vehicles away from the edge, or prevent workers being injured in a fall.
Structural support was not provided to the sides of the excavation pit, which were partly made of soft clay, and the sides had not been sufficiently battered back to a safe angle.
Track marks showed a digger had been driven along the rim of the excavation, which increased the risk of it collapsing or the vehicle falling into the pit with the lack of fencing.
Huntsmere pleaded guilty to breaching regulations by failing to prevent workers being put in danger. The company was fined £3,000 and ordered to pay £3,837 in prosecution costs.

Allotment owners furious with council over lack of security fencing hire
Allotment holders in Woodley, Wokingham have declared the town council “not fit for purpose” after they had continually failed to organise security fencing.
At the annual meeting of the Reading Road Allotments’ Tenants Association, the gardeners declared the council was “failing in its duties” to protect the site from vandals.
There was a unanimous agreement among members that the committee should contact the National Society of Allotment and Leisure Gardeners for legal advice. At the meeting, allotment holders were also told that their offer to repair the fencing themselves had been rejected by Woodley Town Council.
The lack of security fence hire saw the 300 allotments repeatedly vandalised last year, forcing desperate tenants to call for razor-wire fencing to keep thieves out.
“The council said there was no money for repairs and no labour,” said Scott Golding, from the association’s committee, after the meeting.
“The atmosphere at the meeting was very hostile towards the council.
“With the light nights coming in we are extremely concerned that the vandalism will start again.”
Councillor Beth Rowland, leader of Woodley Town Council, said the allotment holders did have a valid criticism about the repairs, but they were very impatient.
“We have been slow getting started but 30 metres (of fencing) has been replaced in the last few weeks. The association only gave us the invitation to the meeting three days before and those who would know anything about it had other things in their diaries.”
Kevin Murray, service support manager at the town council, said the site was currently being assessed and repairs were ongoing, with the most vulnerable areas being sorted out first.

Metal fence hire – pensioner damages council-owned fence boundary
A pensioner has been handed a criminal record for cutting down a metal fence which divided a Shropshire town.
Great-grandfather Derek Baddeley used an angle grinder to remove the 6ft metal fencing that was blocking a public right of way.
The caution describes how Mr Baddeley ‘without lawful excuse, damaged a fence to the value of £500 belonging to Sam Walton’. Mr Baddeley today said he was ‘not happy at all’ to have ended up with a criminal record at the age of 65, adding that by removing the fence with two others he probably saved taxpayers money in potential legal costs.
He said: “I don’t feel like a criminal, but I suppose as long as the right of way remains open, it has been worth it. I was extremely concerned as to just how much the situation was costing council taxpayers.
“We knew from the outset that the barrier was illegal and it took seven months to prove the point, but the barrier was still there despite a council report being published saying they’d decided it should be removed.”
Constable Martin Powell, of Market Drayton police, said: “Police will continue to monitor the situation in Grosvenor Road.”
The row over the fence started last August when it mysteriously appeared overnight and separated Grosvenor Road from the Fairfields Estate.
Opponents said it hindered people’s access to the town centre, but supporters said it was needed to tackle anti-social behaviour. At one stage the fence was adorned with barbed wire and anti-climb paint. A Shropshire Council report prompted by Market Drayton Town Council recommends recording Grosvenor Road and a footpath into Fairfields Estate as a public bridleway.

Protecting equipment with Site Fencing
When you have several expensive pieces of kit on site you can’t be too care full, if you want to avoid costly insurance premiums and the down time involved with kit being replaced you need to ensure you hire in some site fencing to keep everything secure.
